AC unit dilemma

My friend has a home that is going into foreclosure. He has tenants who are living in the home basically for free. They are behind on rent and he allows them to live there because its going into foreclosure and because its better than an empty home.

The AC unit in the home went out and the tenant called to tell him about it. He obviously doesn't want to fix the AC in a home that he will lose in a few months. But there are tenants living in there, so I think he probably has to fix it. But since they aren't paying tenants and should have been evicted months ago, does it still apply? I guess in this case its probably better to evict the tenant and have an empty home until foreclosure? This way you don't have to fix anything that breaks.
