So we have a new idea for a product and while we have ours own formulation being made, I wanted to know the legality of taking another product and relabeling it.
I know private labeling is big business, but that has the knowing concent of the company so its not the same thing.
Here's an example of what I'm talking about. Buying "natures way" brand vitamin B pills from your local CVS (or even from a distributer). Taking off the label. Printing a label called "fastlane bobs" vitamin b pills and putting it on there.
I know this is a big NO NO with stuff like software where you are technically licensing the product. But since you own it I would think this falls under the right of first sale. We wouldn't be using any copyrighted or trademarked material, since their brand is not used. This isn't pharmaceutical, so actual formulas cannot be copyrighted (That's why herbal supplements use "proprietory formula" groups on the lbaels instead of listing how much of everything there actually is)
Any FACTUAL advice would be appreciated. I'm not looking for the morality police or opinions on the subject if you have no actual idea how this would be viewed in the laws eyes.
