Vig, that's not really what the ToS says. I'm going to quote it, because there's a pretty massive and important difference between what it actually says and what you just said. It says:
In consideration for your agreement to the terms and conditions contained herein, VC [Viperion-Ed] grants you a personal, non-exclusive, non-transferable license to access, use, and contribute to the site. You warrant and acknowledge through your explicit use of TFF in any manner available (blogs, commenting, thread creation, topic posting, hereto referred to as "Contributed Content") that any such Contributed Content (posts, threads, blogs, and any use of the site's public publishing/commenting system) MAY BE retransmitted or republished in secondary publications for editorial, discussionary, or opinionated commentary, including but not limited to blogs, books (printed or electronic) or other commercially distributed content. Furthermore, by posting and submitting "Contributed Content" to TFF, either directly or indirectly, responding to posts, threads, private messages, or other means for providing "Contributed Content" to us, you grant us a perpetual, non-exclusive, fully paid, royalty-free, irrevocable, sublicenseable, worldwide license and right to display, use, perform, reproduce, modify, distribute and create derivative works of the Submission or information submitted in any media, publication, software, or technology of any kind now existing or developed in the future. You agree that we are free to use any "Contributed Content" posts, comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send or provide to us including, without limitation, responses to threads, postings, or commentary to TFF without further compensation, acknowledgement, or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving TFF, and/or VC's products and services.
This makes sense. The posts, etc. can be freely quoted, used for advertising, in books, etc. without legal dispute forever. Solid.
If interpreted literally, what
you said would mean that, hypothetically, Vic would have to email MJ every time he wanted to use a picture from his progress thread on Instagram, or maybe even before he sent his rapid prototype, which he illustrated for us, to be produced. That does not make sense. According to ToS, Viperion is the unlimited free licensee of the content forever, but they do not own it as such. No thread creator ever has to ask Viperion for permission to do anything with content they've created for the forum, as far as a plain-sense understanding of the ToS is concerned, at least as far as I saw. Maybe Esquire or someone else with a law degree can chime in if I'm wrong, or you can quote the relevant section.
