I need some advice here make sure I don't make myself look like an idiot.
I will try and compress this down to as short as possible.
I hired a guy to do programing work for me who lives in California. He completed a first job for me, I payed him $560 to do so. After that I needed another larger job done. We got to talking, he was interested in partnering on the project. No money out of my to have the project done, but he would have part equity. I was fine with this. Tough after a few days he decided not to, and gave me a price for the project. Which I agreed to, and payed him a deposit of 50%.
I was very excited for the completion of the project, so much that I wasnt thinking straight. Wanting him to 'expedite' the I gave him the rights to sell the script that he had recently coded for me. With the understanding that he would program a more complex one later. Time when on, progress was Very slow on the new project that I had already paid the deposit for. Me just wanting to it done, I told him I'll just pay him the balance remaining so that I didn't need to worry about it anymore and so he could bring on another guy to get it done faster.
Of course hindsight is 20/20... He now refuses to work on the project, or refund my money. I am ready to take him to small claims to get my money back.
I have 100% of everything said above in writing. (chat logs)
So I advised him that I would be taking him to small claims court, he responded with expected tough guy talk. But he did make a comment, "pretty hard to dispute monetary loss through a Canadian bank"
Now me younger and not very legally inclined at all...would this have any affect on the case?
Also, any other suggestions?
