I have some follow-up questions:

1. When would it not be necessary to get a patent. It was mentioned that most ppl applying shouldn't really get a patent.

2. If you prove the market before investing time and money into full production, and even patent, then as we discussed - the chinese market can reverse engineer and have a copycat product to market within days - not necessarily the 12-18 months that may have been true in the past. Wouldn't a patent be a good idea then?

I guess it's a which comes first - chicken or egg syndrome. Damned if you do and damned if you don't?

The problem is that so many new inventors think that getting a patent is one of the first steps, and there are so many entities after their money who will encourage them to so so. A Provisional Patent Application (PPA) affords no legal rights but is a much less expensive option that establishes a priority date and gives you twelve months to file a Utility Patent. This time window can be used strategically to license or venture your product before spending the big bucks.

To specifically answer your question, a patent can be unnecessary, or even undesirable, for a few reasons. It may be better to maintain your intellectual property as a trade secret. It’s important to understand that the basic concept of a patent is that in return for the protection it affords, the inventor will fully disclose the invention for public use after the protection period. If your product can’t be reverse engineered (these are almost always compounds - Coca Cola, KFC, WD-40) keeping the recipe as a trade secret provides a protection period with no limit. A patent can also be deemed unnecessary for fad/novelty items when first-to-market is much more important.

A lot of inventions, while truly innovative and marketable, may not meet the USPTO’s criteria (most often “obviousness”) and cannot be patented.

In all cases, other IP tools - Trademarks and Copyrights - can be leveraged to help protect your brand.

A patent is almost always a good idea for any product that can be successfully marketed. For protection from pirates, especially in China, additional measures can be considered. When sourcing an innovative product from China, an NNN Agreement (Non-disclosure, Non-compete, Non-circumvention) should always be used. Other measures to be considered are registering your trademark with US and Chinese Customs Agencies, Trademarking in China, and filing international patents through WIPO.

Legal measures can get expensive fast and, like fences, they only keep honest people honest. For others enforcement is required and that gets REAL expensive. The reality is that most don’t want to copy your product and your best defense is a GOOD BRAND, which cannot be pirated if you have a few simple measures in place. Being FIRST TO MARKET with a good innovation can never be copied. Look at the continuing success of YETI in spite of arguably equal products that sell for half the price. The take home message is to do your due diligence, build a strong brand brick by brick, and don’t get districted by the paranoia noise. ALL successful companies deal with competitors crossing the line; it should be considered a part of the business landscape and not a source of fear.
